The EFECT program offers the self-employed and SMEs the possibility to invoice at any time. It is a complete mobile IT solution to assist SMEs and the self-employed in their administrative and commercial activities. In this context, EFACT is tasked by its users to collect, process and analyze - on their behalf - data processing relating to their customers. Therefore, EFACT acts as a “processor” with regard to its users, who remain - each as far as they are concerned - “controller”.


2. What categories of data are possibly processed by EFACT?


2.1. It can be the following data:


Personal identification data (surname, first name, postal address, email address, telephone / mobile / fax number, website URL address, date of birth, place of birth, national register and identity card number, marital status , Photo);
Professional data (company name, registered office, company / VAT number, professional telephone number, professional email address, website URL address, function, status, name of representative);
Financial data (bank account number);
Data relating to behavior and browsing habits on the sites and applications of the controller;
Any other data that you voluntarily communicate to the controller.


2.2. It is possible that EFACT is also required to collect non-personal data. These data are qualified as non-personal data because they do not allow you to be identified (directly or indirectly). These data may therefore be used for any purpose whatsoever, for example to improve the service of EFACT, the products and services offered by the controller or third party partners.


2.3. In the event that non-personal data is combined with personal data, so that the identification of the data subjects is possible, these data will be treated as personal data until their reconciliation with a particular person is made impossible.


3. For what purposes does EFACT process your personal data?

3.1. EFACT's activity consists of offering SMEs and freelancers to create clients and documents (invoices, pro forma, credit note, order form, quotes, etc.). In this context, EFACT - acting as a "subcontractor" - is responsible by its users to collect, process and analyze, on their behalf, data processing relating to their customers, documents, for the following purposes:


1. for customer management;

2. for the creation of documents (invoices, pro forma, credit note, purchase order, estimate, etc.);

3. for the use of the software;

4. for the use of intercom.io (location, time management, etc.);

5. in order to provide you with promotional information on the products and services of the data controller and its partners (direct marketing);

3.2. EFACT could be required to carry out processing operations which are not yet provided for in this Charter. 4. What are the legal bases for the processing (s) of your personal data?


The legal basis for processing your data varies depending on the processing concerned. In principle, when collecting your data, the controller informs you of the manner and modalities of collecting and processing your data. On this occasion, it communicates to you the legal basis of the processing.


For example, your data may be collected and processed on the basis of the contractual (or pre-contractual) relationship you have with your real estate agent / developer. Your data is processed by EFACT and, where applicable, jointly with various commercial entities or agents, mainly internally. EFACT employees, agents or other agents can access your personal data, only if it is necessary for operational purposes or in the performance of their task (eg maintenance of EFACT software, etc.).

6. What are your rights and how can you exercise them?


6.1. Right to withdraw your consent. This withdrawal does not affect the lawfulness of the processing carried out before the withdrawal of your consent. EFACT offers all real estate agents and developers who are part of its clientele the possibility of having a link in all emails sent. It is however the responsibility of each customer to check this link and to record it in all their emails.


6.2. Right of opposition. When the processing of your data is carried out for direct marketing purposes, you can at any time object to the use of your data for this purpose.


6.3. Right of access and copy. In any case, you can obtain a free copy (including in electronic format) of your personal data as well as, if necessary, rectify, complete or delete data which are inaccurate, incomplete or irrelevant.


6.4. Right to data portability. You can also, at any time, request to receive your personal data free of charge in a structured, commonly used and machine-readable format, in particular with a view to transmitting them to another controller.


6.5. How to exercise your rights? If you wish to exercise any of the rights described above, you must send your written request (including in electronic format), dated and signed directly to your real estate agent / developer, providing proof of your identity. You will receive an answer as soon as possible, at the latest within one month. After this period, you can consider that the request has been rejected. In the event of a refused request, it is the President of the Court of First Instance who hears any request relating to the right to obtain communication, rectification, deletion or limitation of personal data.



7. What is the retention period for your personal data?


The retention period of your personal data varies depending on the type of data and regulations.


In its software, Efact offers its customers all the useful technical possibilities so that personal data is not kept beyond the time necessary to process them, for which they were collected.


At the end of the retention period, EFACT makes every effort to ensure that your personal data has indeed been made unavailable.


8. What security measures does EFACT take?


EFACT implements the appropriate technical and organizational measures to guarantee a level of security of the processing and the data collected with regard to the risks presented by the processing and the nature of the data to be protected adapted to the risk.


EFACT always uses encryption technologies which are recognized as industry standards within the IT sector. In any case, EFACT implements appropriate security measures to protect your personal data against loss, theft, misuse or alteration of information received, disclosure or unauthorized use.


9. Article specific to EFACT software users


9.1 Synchronization with Google


We use Google OAuth 2.0 to enable data exchange between Google API gmail.com and the efact.be customer account. In this way, we synchronize the smtp for use of sending the documents generated by efact.be with Google email. Changes can be made either on Google or on EFACT, and you will see their changes through efact.be synchronization.

Access and refresh tokens are securely stored in our database and are handled in accordance with this private statement.


9.2. If you are a user of the EFACT software and you wish to exercise one of the rights in article 6 described above, you must send your written request (including in electronic format), dated and signed directly to EFACT, providing proof of your identity.
